FICA tip credit (Section 45B)
Can you claim the FICA tip credit for past years?
Updated · Checked against primary sources
The short answer
Yes. Form 8846 says you can claim the credit within 3 years from the due date of your return, on the original or an amended return. Sole proprietors amend Form 1040, C corporations file 1120-X, S corporations file an amended 1120-S with amended K-1s, and BBA partnerships must file an administrative adjustment request rather than an amended return.
Key takeaways
- Window: 3 years from the return's due date (Form 8846); the refund statute in IRC 6511 caps the amount.
- Pass-through owners get the benefit on their own returns, via an amended K-1 (S corp) or an AAR (partnership).
- There is no general "IRS pays in 90 days" rule. IRS publishes 8 to 16 weeks for amended individual returns only.
- A licensed preparer should file. The credit also reduces the prior year's FICA deduction, which changes taxable income.
How each entity type claims prior years
The mechanics depend on how the restaurant is organised, and partnerships are the case most guides get wrong.
| Entity | How to claim a prior year | Where the credit lands |
|---|---|---|
| Sole proprietor | Form 1040-X with Form 8846 | Owner's return |
| C corporation | Form 1120-X with Form 8846 | Corporation |
| S corporation | Amended 1120-S (box H(4)), amended K-1s | Owners, K-1 box 13 code N |
| BBA partnership | Administrative adjustment request (Form 8082), not an amended return | Partners, in the year the AAR is processed |
How long the refund takes
The IRS says to allow 8 to 12 weeks, and up to 16, for amended individual returns (IRS). It publishes no processing time for amended business returns. The only statutory 90-day clock is the tentative refund under IRC 6411 for carrying an unused credit back, filed within 12 months of the credit year.
Frequently asked questions
- What if I had losses in those years?
- The credit is nonrefundable, so it only reduces tax you owe. Unused credit carries back 1 year and forward up to 20, so a loss year can still produce a usable carryforward.
- Do absentee owners benefit?
- The credit flows to owners, but credits from a passive activity can only offset tax from passive activities. An owner who does not materially participate may not be able to use it right away.
